John McCain - Imperialist

Great catch by Dean who was watching Fox and Friends this morning, when John McCain said the following:

I also strongly recommended that we use the exchange stability fund that the Treasury has available – $250 billion – to shore up these institutions. Also, the Treasury has at its disposal about $1 trillion that they could begin without Congressional authority buying up some of these terrible mortgages and help stabilize the situation.
...
I talked to the President.  We have to act, even though we failed yesterday...

Think about what John McCain is saying here.  The fact that Congress refused to pass this bill, the Treasury department should still spend a trillion dollars and buy up these loans now, without Congressional authority.  Frankly, I'd like to know under what current statutes that would be permissible.

This is not Democracy.  Having the executive branch act unilaterally without legislative approval is imperialism.  He is saying that since the legislature did not pass the President's bill, the President should do whatever he wants anyway, as if the bill had passed.  I wonder what other actions John McCain would take without Congressional approval.

The audacity of that man boggles my mind.  You know... there were fleeting moments in the last month where I actually thought I might hold my nose and vote for him.  This one does it.  There is no way in hell I'd vote for him now.

So if they've already got a trillion dollars laying around to piss away, what was the point of the last week of negotiation?

Honestly, I don't know... which is why I asked what current statutes would allow that. I see two possible explanations for what McCain said.

1. He's simply flat out wrong, and the Treasury does not in fact have the $1 trillion to legally use today, but he'd like them to do it anyway. This is purely undemocratic and an executive power grab of massive proportions.

2. The statute actually does exist, but several weeks ago it was discussed, and the executive branch decided that this was such a massive action, that it was still better to ask permission.

However, now that they've gone down the route of asking permission first (a good thing) and failed, they have to choose whether to continue trying to get permission, or go back and say... we didn't need your permission anyway.

This is almost just as bad as #1, because it still brings on the spector of ignoring the democratically elected will of the people. They asked, didn't like the answer they got, but decided they're going to do it anyway. I'm really not sure that's any better.

Yep, I agree with you there. Perhaps the existing statute doesn't give Paulson the lack of oversight he was seeking with the original bill.
