Mistakes sometimes happen when police conduct home searches, the Supreme Court said Monday in throwing out a lawsuit brought by a white couple in Southern California who were rousted from bed and held naked at gunpoint by deputies looking for several black suspects.

The search of Max Rettele and his girlfriend, Judy Sadler, in their bedroom may have been an error, and it was certainly embarrassing to them, the justices said. But it did not violate their rights under the 4th Amendment, which protects against "unreasonable searches and seizures," they added.

When the deputies set out to raid a home in Lancaster, they did not know the suspects had moved three months earlier. Rettele had bought the home in September and lived there with Sadler and her 17-year-old son.

The deputies then entered the bedroom and ordered Rettele and Sadler to get up and to show their hands. They protested they were not wearing clothes, but the officers insisted they stand naked next to the bed for a minute or two.

I don't think that was the kind of gun they were worried about.

One more thing; with IE7, the comment box scrolls off the right edge of the screen in 1280x1024. Micro$soft really needs to fix their browser.

Yeah... I'm not sure where you're coming from as far as your question goes Elliot.

If it had been a typical no-knock warrant that entered the wrong house, and the home owner shot at the police who he thought were intruders... odds are the homeowner would have been shot and/or killed, and the cops would have said it was justified to defend themselves.

If somehow the homeowner didn't die when shooting at the cops, and a cop had, then odds are that homeowner would be prosecuted and likely convicted and sentenced to death for defending his home.

But hey... that's all worth it to get a couple ounces of pot under most circumstances... right?

I have in mind to cover this sort of thing in a lot more detail at some point... but I'm not the only one who is very worried by this behavior. I've eluded to it many times, but there are are a few other bloggers who hit it hard core. It's scary.

But would it be "all worth it" if the no-knowkc warrant was to snare a terrorist?
