Even though I'm against abortion, and think it should be curtailed greatly, if not banned altogether... this story just confuses the hell out of me:
A 24-year-old New York woman was charged yesterday with second-degree self abortion after police say she tried to terminate a 13-week-old pregnancy by overdosing on a cocktail of over-the-counter and prescription medications.We're noticing an unusual trend. Last month, police decided not to file charges against a Georgia woman who performed a self abortion and stored two fetuses in her shed. A few weeks ago, prosecutors decided to charge a Massachusetts woman with "procuring a miscarriage" instead of murder after she allegedly took a drug that caused the premature birth of a baby that weighed a little more than a pound and died four days later.Late last year, a judge ruled that a Virginia woman couldn't be charged with causing an abortion after she shot herself in the stomach in a desperate bid to end her pregnancy.
Given the current state of abortion law, why is this illegal? She could go to a clinic and get an abortion legally. She could probably go somewhere and get Plan B (not to different than what she did) and that would have been legal. So why is this any different? I'm not looking at opening up a debate on whether abortion should be legal on the whole... I'm wondering why this was illegal given that so many other options are legal.
I mean... if I dislocated my shoulder, would it be illegal for me to relocated it myself instead of going to the emergency room? It might be stupid... but illegal?
