Arrested For What?

Hopefully there will be a little more information posted on this "breaking story" later:

Waukesha police arrested a 72-year-old man walking near Hawthorne Elementary School with a pellet gun this morning, Capt. Mike Babe said.

Babe said he doesn't know why the man was walking with the gun but the action prompted a driver to call police because the gun looked real.

The man was taken into custody without incident at 10:15 near the intersection of Hawthorn Drive and Moreland Blvd.

That's all there is to the story.  What was the crime?

Update:  JSOnline Day watch is now saying that he was "ticketed"... but still haven't said what the ticket is for.  What crime did he commit?  Anyone?  Please?

I'm sure there's some ordinance they can find to charge him with whether he intended mischief or not.

It is illegal to have a gun within (I believe) 1,000 feet of a school. Also, a disturbing the peace citation would probably be given for anyone displaying a gun in public. While a concealed gun is illegal in Wisconsin at any time (one of only 2 states in the nation), having one in the open will usually get you a ticket too. So you are damned if you do, and damned if you don't conceal it.

As for this case, I don't know any details though, just thought I would toss in my 2¢

If you're referring to the federal Gun Free School Zone's Law, that was actually struck down. One of the few times the Supreme Court ever decided that a law passed by Congress didn't meet the standard of affecting interstate commerce in recent years.
